Insider Dealing Defence Solicitors

Insider dealing is prosecuted under the Criminal Justice Act 1993 and investigated by the Financial Conduct Authority. ASA Solicitors provides specialist defence in FCA and market-abuse cases.

The offence

Section 52 of the Criminal Justice Act 1993 makes it an offence for an insider to deal in securities on the basis of inside information, or to encourage another to deal. The offence is triable either-way and punishable by imprisonment. Cases turn on whether the information was inside information and how it was obtained.
