Who’s Involved in Care Proceedings? Guardians, Judges, and Children’s Services Explained

They do not work for the local authority. Their role includes meeting with your child, you, your family members, and professionals such as teachers, doctors, and the child’s social worker. The Guardian provides a report to the court with their recommendations.

Children’s Services is the department within the local authority responsible for providing services to children. It was previously referred to as social services.

A Judge is the person responsible for making legal decisions in family proceedings or care proceedings. Judges preside over cases in county or crown courts and have the final say in most decisions.

Magistrates are lay individuals who hear cases in magistrates’ and family courts. Typically, a panel of three magistrates works together as a bench to make joint decisions in care proceedings

Family Group Conferences and Legal Roles in Child Protection Cases

A Family Group Conference is a structured meeting where extended family and friends come together to develop a plan for the welfare of a child. It is coordinated by an independent facilitator who supports the family in finding solutions.

In some cases, the court may appoint a Guardian to make decisions in legal proceedings for individuals who cannot do so themselves. This Guardian will instruct the solicitor, consult the individual, and act in their best interests. If no one is available, the Official Solicitor may act as Guardian when requested by the court.

A Solicitor or Barrister is a legal professional who advises and represents individuals in court proceedings. In care proceedings, they help families present their case and navigate complex legal matters. These legal professionals are often collectively referred to as lawyers.
